====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Bettiah (T) P. S. Case No.769 of 2020, instituted for the offences under Sections 379, 411, 414/ 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 04.12.2020 and he is a person with clean antecedent, charge-sheet has been submitted in this case. The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant alleges that theft of marriage article which was recovered from the fruits shop of Kundan Kumar, who disclosed the name of this petitioner and two others that

The learned counsel for the petitioner submits that no one has seen the occurrence and it is on the basis of confessional statement of aforesaid Kundan Kumar, the petitioner came to be implicated in the present case.

Learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 04.12.2020 and he is a person with clean antecedent, charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Bettiah (T) P. S. Case No.769 of 2020.

The application stands allowed.
