JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 27-03-2015 Petitioners pray for quashing of the cognizance order dated 2.6.2012, passed by the Chief Judicial Magistrate, Gaya in GR No. 416 of 2012, Tr.No.2358 of 2012 by which cognizance has been taken against the petitioners for offences under section 498A of the IPC and 3⁄4 pf the DP Act.
On 30.10.2012 the matter had been referred to the Patna High Court, Medication/Conciliation Centre. Today, in spite of notice, no one appears for the opposite party. Counsel for the petitioners refers to a mediation report dated 27.2.2013 along with a compromise petition stating that the dispute between the parties has been resolved through the process of
Patna High Court Cr.Misc. No.29892 of 2012 (4) dt.27-03-2015 2/2 mediation in terms of settlement mutually agreed upon by them. In paragraph 8 and 10 thereof, the parties have agreed to withdraw their respective cases filed against each other in terms of the agreement.
In view of the aforesaid development, cognizance order dated 2.6.2012, passed by the Chief Judicial Magistrate, Gaya in GR No. 416 of 2012, Tr.No.2358 of 2012 taken against the petitioners for offences under section 498A of the IPC and 3⁄4 pf the DP Act, is hereby quashed.
