The petitioner apprehends his arrest in Panapur P.S. case No. 41/2016 under Section 413, 414/34 of the Indian Penal Code and under Section 11(d) of the Prevention of Cruelty to Animals Act, 1960.
The informant alleged that he intercepted a vehicle carrying animals but the accused persons, Rajinder Ram and Raj Kumar Nat, fled away. The informant did not disclose the name of the driver. The petitioner is driver of the vehicle. The petitioner was plying the vehicle on hire. The animals were not stolen property.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.30251 of 2016 (2) dt.09-09-2016 2/2 allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Saran at Chapra in Panapur P.S. Case No. 41 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
