Petitioner, who is in custody, seeks bail in connection with Jadopur P.S. Case No. 72 of 2017 (G.R. No. 2738 of 2017), registered for the offences punishable under Sections 341, 323, 324, 325, 307, 504/34 of the Indian Penal Code.

Informant has alleged that his uncle Raghunath Pal and one Sitabi Pal were assaulted by petitioner by iron rod on their head as a result of which both have sustained grievous injuries and during treatment Sitabi Pal died. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case due to land dispute. Similarly

Patna High Court Cr.Misc. No.78803 of 2018(3) dt.04-02-2019 2/2 placed co-accused have been granted bail by this court and by the co-ordinate bench of this court as contained in Annexure-2 series. Petitioner has no criminal antecedent and is in custody since 25.08.2018.

Considering the facts and circumstances of the case and there is direct allegation against the petitioner, as such, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected. Trial court is directed to expedite and conclude trial within a period of one year from the date of receipt/production of a copy of this order.
