JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-01-2017 The present application has been filed for modification of the order dated 12.09.2013 passed in Cr. Misc. No. 27115 of 2013 to the extent of extending the period of provisional bail.

The petitioner was granted provisional anticipatory bail for six months in connection with Risiup P.S. Case No. 37 of 2013 registered under Sections 406 and 420 of the Indian Penal Code.

The prosecution case is that 6929.74 quintals of paddy was given to the petitioner for supply of custom mill rice but the petitioner could not supply the processed rice. On submission of the counsel for the petitioner that petitioner is ready to supply the due processed rice within a period of six months, the petitioner was granted provisional anticipatory bail for six months. Patna High Court Cr.Misc. No.49397 of 2015 (2) dt.11-01-2017 2/2 below was supposed to issue notice to the informant for supply of the quantity of rice due with the petitioner. The provisional bail of the petitioner was to be confirmed by learned Court below on supply of the custom mill rice.

It appears that earlier also a modification application was preferred vide Cr. Misc. No. 15141 of 2014 for modification of the order dated 12.09.2013 passed in Cr. Misc. No. 27115 of 2013 when the modification was declined and the modification application was disposed of vide order dated 12.08.2015.

This Court finds no merits in entertaining the second modification application.

Accordingly the modification application stands dismissed in connection with Risiup P.S. Case No. 37 of 2013, pending in the Court of learned Chief Judicial Magistrate, Aurangabad.
