The petitioner has filed the instant application for grant of regular bail in connection with Excise Case no. 396 of 2019 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016 As per the FIR, 18 litres of country liquor and other articles for manufacturing liquor were recovered and were said to be belonging to the petitioner.

It is submitted by learned counsel for the petitioner that the allegations as made in the FIR are false and concocted. The petitioner is in custody since 17.11.2019. It is submitted that the earlier application for bail of the petitioner was rejected vide order dated 17.12.2019 (Annexure-1) passed in Cr. Misc. no. 83857 of 2019.

Having heard learned counsel for the parties and taking into consideration the fact of the petitioner having remained in custody since 17.11.2019, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on
