JUSTICE SHIVAJI PANDEY ORAL ORDER 23-09-2015 Heard counsel for the petitioner and the O.P. In this case petitioner is seeking anticipatory bail in Runisaidpur P.S.Case No. 127 of 2012 registered u/s 341, 323, 342, 353, 379, 504/34 IPC.

This case has been lodged on the complaint of C DPO, Runisaidpur making allegation that she had visited t he Centre and had found that the materials which were to be distribute d were not present. She demanded the relevant Register whereupon the Sevika, Gudia Sharma and her husband (petitioner) misbehaved with the informant.

On perusal of the case diary it appears that all the witnesses have stated that the CDPO had seized the register whereupon there was altercation with the driver.

No.42100 of 2014 (4) dt.23-09-2015 2/2 Looking to the facts and circumstances of the case, in the event of arrest or surrender within 4 weeks, petitioner Ved Prakash Sharma is directed to be released on anticipatory bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.K.Sinha, Judicial Magistrate, 1st Class, Sitamarhi in connection with Runisaidpur P.S.Case no. 127 of 2012 (Trial No. 3184 of 2014), subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
