2. The petitioners apprehend their arrest in a complaint case punishable for the offence under Sections 80 / 3
(5) of BNS.
3. As per prosecution case , daughter of informant was married with co-accused Deepak Kumar in the year 2024 and after the marriage, she was subjected to cruelty and harassment by all the accused persons due to non-fulfillment of additional
Patna High Court CR. MISC. No.26031 of 2025(2) dt.08-07-2025 2/3 demand of dowry and ultimately on 18.09.2024 the accused persons committed the murder of informant's daughter by strangulating her.
4. Petitioner no. 1 is father-in-law petitioner no. 2 mother-in-law , petitioner No. 3 is married sister-in law and petitioner No. 4 is also sister-in -law of the deceased. There is general and omnibus allegation against these petitioners. No specific overt act is alleged against these petitioners. As a matter of fact, deceased committed suicide by hanging after bolting and police has recovered the dead body after breaking the door of room of deceased. Thrust of the accusation is against husband of the deceased, who is already in custody since 24.06.2025 . Petitioners are separate in mess and property and have got no concern with the family affairs of deceased and her husband. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail of petitioners.
6. However, considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the
Patna High Court CR. MISC. No.26031 of 2025(2) dt.08-07-2025 3/3 satisfaction of learned Chief Judicial Magistrate Gopalganj in connection with Mohammadpur P.S. Case No. 209 of 2024 , subject to condition as laid down under Section 482 ( 2 ) of BNSS 2023 .
