JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and learned APP representing the State.
The petitioner apprehends her arrest in connection with Mahua P.S. Case No. 14 of 2016 registered for the offences punishable under Sections 302/34/201 of the Indian Penal Code. Allegedly, the petitioner and other co-accused killed Kiran Kumari, who was the step daughter of the petitioner, by strangulating her. During investigation the dead body was recovered and post mortem was done.
Submission is of false implication and that against the petitioner there is no specific allegation, the petitioner has got no concern, as a matter of fact the deceased committed suicide and as such the petitioner deserves sympathetic consideration. Learned APP opposes the prayer of pre-arrest bail by submitting that the witnesses have supported the prosecution
Patna High Court Cr.Misc. No.31246 of 2017 (3) dt.19-08-2017 version vide paragraph nos. 4, 5, 10 to 13 and 16 of the case diary and post mortem report also corroborates the prosecution version. In the facts and circumstances stated above, considering the allegation attributed against the petitioner, I am not inclined to grant privilege of pre-arrest bail to her, accordingly, her such prayer stands rejected.
