20-02-2019 Heard Sri Manoj Kumar, learned counsel for the petitioner and Sri Amit Kumar Rakesh, learned Addl. Public Prosecutor.
This is 3rd attempt for grant of bail on behalf of the petitioner, who is in custody in Sessions Trial No. 731 of 2016 {arising out of Phulwarisharif (Janipur) P.S. Case No. 237 of 2016} registered under Section 366(A)/34 of the Indian Penal Code.
It was submitted by learned counsel for the petitioner that petitioner is in custody since 23-04-2016 and despite last direction of this Court, trial has not concluded till date. In this case, by order dated 16-01-2019, a report was called for from the court below, which has been received and kept at Flag 'A'. The report under the signature of learned
Patna High Court Cr.Misc. No.78154 of 2018(3) dt.20-02-2019 2/2 Additional Sessions Judge, XIII, Patna, contained in letter no. 03/19 dated 21-01-2019 makes it clear that almost all the witnesses have been examined and a date was fixed for examination of the investigating officer. Meaning thereby that the trial is almost at the fag end and as such, there is no reason to review my earlier order.
The prayer for bail again stands dismissed.
