The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Kanti P.S. Case no. 739 of 2021 instituted for the offence under Sections 147, 341, 323, 504, 506, 379, 307 and 354 of the Indian Penal Code.

It is a case of assault upon the informant by means of iron rod, due to which, he sustained injuries. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case. He further submits that doctor has found the injury to be simple in nature. There is case and counter case between the parties. Both parties have sustained injuries in the alleged incident. Similarly

Patna High Court CR. MISC. No.24147 of 2022(2) dt.10-10-2022 2/2 situated co-accused has already been granted anticipatory bail by this Court vide order dated 31.08.2022 passed in Cr. Misc. No. 31756 of 2022.

Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Kanti P.S. Case no. 739 of 2021, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur subject to the conditions as laid down under section 438(2) of the Cr.P.C.
