2. The petitioner in the present case is seeking prearrest bail in connection with Harnaut P.S. Case No. 427 of 2023 registered for the offences punishable under Sections 409, 420, 467, 468, 471 and 120(B)/34 of the Indian Penal Code. He has got no criminal antecedent.
3. As per the prosecution story, the educational certificates of dismissed Special Survey Amins posted in the Special Survey Camps were examined by the Director, Land Records and Measurement, Bihar and their certificates were found to be fake. An order by said officer was given to lodge an FIR in local police station against the Special Survey Amins.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this
Patna High Court CR. MISC. No.27017 of 2024(3) dt.04-06-2024 2/2 case. It is submitted that the petitioner has already resigned from the service, further he was not been given any opportunity to defend himself prior to lodging of the FIR.
5. Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner. It is submitted that this petitioner had obtained his appointment as Special Survey Amin in Special Survey Camps on the basis of fake educational certificate.
6. Having regard to the fact that the petitioner had allegedly obtained his appointment as Special Survey Amin in Special Survey Camps on the basis of fake educational certificate, considering the seriousness of the allegation and the conduct of the petitioner, this Court is not inclined to grant him privilege of pre-arrest bail. Prayer is refused.
7. In case the petitioner surrenders and prays for regular bail within a period of four weeks from today, his prayer for regular bail shall be considered on its own merit without being prejudiced by order of this Court.
