The petitioner apprehends his arrest in connection with Complaint Case No. 3014 (c) of 2011 registered for the offences punishable under Sections 498(A), 323, 354, 120B 355/34 of the Indian Penal Code and Section 3⁄4 of the D.P. Act. Today, the petitioner and the opposite party no. 2 are present in Chambers in person.
After much deliberations, it has transpired that the petitioner is willing and ready to keep the opposite party no. 2 with full dignity and honour and shall ensure a harmonious matrimonial life to her matrimonial home. The opposite party no.
2, on the other hand, submits that she is also willing and ready to cooperate and live in her matrimonial home with all other family members and shall not level any unnecessary allegation against them.
Considering the positive attitude of both the parties, this court feels that the interim order passed in favour of the petitioner be confirmed, accordingly, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in connection with Complaint Case No. 3014 (c) of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.. However, it is made clear that petitioner shall take appropriate steps to bring the opposite party no.
2 in her matrimonial home within a period of three months from today and re-establish appropriate harmonious life with her. In the meantime, petitioner shall visit the opposite party no. 2 at her father's home so that the confidence may inspire in the mind and heart of the opposite party no. 2.
