Petitioner is apprehending his arrest in connection with Khagaria (Muffasil) P.S.Case no.155 of 2018 , registered for offences punishable under Sections 341, 323, 307, 385, 386, 427, 504/34 of the Indian Penal Code and Section 27 f the Arms Act.
Prosecution case is that the petitioner and other accused personas demanded rangdari from the informant and the petitioner and other accused persons fired on the informant but that did not hit to the informant . Further there is allegation that after some time, the informant came to know that the motorcycle of one James Kumar was damaged and he was also assaulted.
Submission of the learned counsel for the petitioner is
Patna High Court CR. MISC. No.24171 of 2019(4) dt.04-09-2019 2/2 that there is also dispute between the parties which will appear from para 9 and 10 of the case diary and further more the injury of the James Kumar seems to be simple in nature and no specific allegation has been attributed of assault by the petitioner to James Kumar.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Khagaria (Muffasil) P.S.Case no.155 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
