2. The petitioner seeks bail in a case registered for the offence punishable under Sections 308 (5) and 111 (1) of the Bharatiya Nyaya Sanhita, 2023.

3. The prosecution case has been unfolded in the F.I.R. by the informant, Adarsh Kumar Agrawal stating that ransom demand was made by one gangster, Shanker Yadav and he had also threatened the informant.

4. It is submitted by learned counsel for the petitioner that it would be apparent from the F.I.R. that the petitioner is not named in the F.I.R. and no specific allegation has been levelled against him rather the specific allegation is against Shanker Yadav. It is further submitted that the petitioner

Patna High Court CR. MISC. No.22928 of 2025(3) dt.26-05-2025 2/2 was arrested after three days suspecting his involvement in the offence as he was found in the house of Shanker Yadav. No material has been surfaced in the case diary to show the complicity of the petitioner. It is also pointed out that two similarly situated co-accused have been granted privilege of bail by co-ordinate Benches of this Court in Cr. Misc. No.27096 of 2025 vide order dated 06.05.2025 and in Cr. Misc. No.31130 of 2025 vide order dated 20.05.2025. The petitioner has been languishing in custody since 21.12.2024.

5. Learned APP for the State opposed the bail petition.

6. Taking into consideration the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Salmari P.S. Case No.102 of 2024.
