Petitioner is an accused in a case registered for the offences punishable under Section 395 and other allied sections of the Indian Penal Code and under the Arms Act. Prosecution's case, in brief, is that 8/10 miscreants entered into a bank but they did not commit loot of cash due to non availability of key, but they took away mobile phone of the bank personnel and they also assaulted them.
Learned counsel appearing for the petitioner, denying the allegations, submits that the petitioner has falsely been implicated in this case on suspicion. Petitioner is in custody since 25.12.2019.
Learned counsel for the State opposes the prayer for bail. He submits that the petitioner has criminal antecedent. He
Patna High Court CR. MISC. No.21963 of 2020(2) dt.10-07-2020 2/2 points out that on the basis of Call Details Record (CDR) and CAF of the looted mobile phone of the informant and tower location of the petitioner's mobile phone, his name has come in this case during investigation.
