The petitioners apprehend their arrest in connection with Murliganj P.S. Case No. 63 of 2012 registered for the offences punishable under Sections 147, 148, 149, 302 and 323 the Indian Penal Code.

Learned counsel for the petitioners submits that though the name of these petitioners is not included in the first information report but subsequently, co-villagers named these petitioners as part of the members of the Mob, who attacked the deceased leading to his death.

Considering the fact that there is no cogent material in the case diary so as to implicate the petitioners, save and except

Patna High Court Cr.Misc. No.45618 of 2014 (3) dt.01-10-2015 the false statement made by the co-villagers, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No. 63 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C..
