The petitioner is apprehending his arrest in connection with Kotwali P.S. Case No. 775 of 2013 for the offences instituted under Sections 147, 149, 341, 323, 353, 354, 196, 160 and 224 of the Indian Penal Code.
The prosecution story, in brief, is that on 26.12.2013 at 12.30 P.M., a mob of thousand people under the leadership of Rana Ranvir Singh, Anil Singh and Shashi Bhushan Singh being the members of National Builders Association blocked the prohibitory area that is Dak Bunglow Road for going to Governor House and when aforesaid three persons were brought to Kotwali P.S.,15 named accused persons including the petitioner surrounded the said police station and after entering into the
Patna High Court Cr.Misc. No.48668 of 2015 (2) dt.04-02-2016 premises started nuisance and freed the aforesaid three persons from the custody of the police.
It has been submitted on behalf of the petitioner that the petitioner has been made accused due to mistake of fact. The petitioner is a film distributor and he has an office in Maharaja Complex at Frazer Road. It is further submitted that he has nothing to do with the builders. The other co-accused have been granted anticipatory bail by the Court below vide A.B.P. No.18295/2014.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Kotwali P.S. Case No. 775/2013 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
