ANJANA MISHRA ORAL ORDER 19-04-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 26.02.2019 in connection with Cheriya Bariyarpur P.S. Case No. 28 of 2019 registered for the offence under Sections 188 and 290 of the Indian Penal Code and Sections 30(a), 30(F) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that total of 26 liters of liquor was recovered from the house, which is in the joint possession of the petitioners and other persons. It is further that there is a family dispute and only to implicate these

It has further been submitted that petitioner no.1 has only one other criminal antecedent which does not relates to an offence of similar nature and petitioner nos.2 & 3 have no criminal antecedents.

Considering the aforementioned facts and circumstances, let the petitioners, above named, be released on bail on their furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum Special Judge Excise Act, Begusarai, in connection with Cheriya Bariyarpur P.S. Case No. 28 of 2019.
