JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-09-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Shambhuganj P.S. Case No. 148 of 2019, registered under Section 306 of the Indian Penal Code.
The accusation is that in the morning of 05.07.2019, informant, Umakant Singh, went at his filed for doing the agricultural work along with his family members. After some time, he received information about committing suicide of his daughter, Juli Kumari, aged about 18 years, by hanging. Thereafter, he reached at his house along with Mukhia then found that the door of the room was locked from inside. On breaking the door, when the informant entered in the room then
Patna High Court CR. MISC. No.21746 of 2020(3) dt.22-09-2020 2/3 saw his daughter in hanging condition with the fan and one mobile of JIO company of his daughter was lying there. At about 11.30 A.M., on JIO mobile of his daughter, one call was received from mobile no. 8210514377 but caller did not speak anything and thereafter, switched off the said mobile. Learned counsel for the petitioner submits that on the basis of written report of informant, Shambhuganj P.S. Case No. 148 of 2019 was instituted under Section 306 of the Indian Penal Code against unknown, but in course of investigation, it was detected that the mobile, as detailed in the FIR, was belonging to the petitioner.
In fact, there was love affairs in between the petitioner and the deceased, daughter of the informant and petitioner wanted to perform the marriage with the deceased, daughter of the informant, but the informant, father of the deceased, was not ready to perform the marriage due to that reason, deceased, daughter of the informant committed suicide by hanging but with ulterior motive, petitioner has been implicated in the present case with false allegation. Further submission is that petitioner is in custody since 29.01.2020.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released
Patna High Court CR. MISC. No.21746 of 2020(3) dt.22-09-2020 3/3 on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Banka, in connection with Shambhuganj P.S. Case No. 148 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
