JUSTICE SATYAVRAT VERMA ORAL ORDER 20-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 23.02.2022, charge-sheet has been submitted in the case and has antecedent of nine cases. Allegation is of recovery of 20 litres of liquor from the jute bag of the petitioner.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case because of his antecedents, the jute bag was lying on the road and the petitioner came to be implicated when he was passing

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 23.02.2022 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Alamganj P.S. Case No. 152 of 2022 (Excise, Special Case No. 29 of 2022).
