17-09-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing. The petitioner seeks bail in Laheriasarai P.S. Case No. 456 of 2019, registered for the offence punishable under Sections 307, 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, the co-accused Raunak Singh is alleged to have fired and caused fire-arm injury at the chest of brother of informant. It is further alleged that other coaccused also fired , however no injury was caused to anyone. It is submitted on behalf of petitioner that petitioner is named in F.I.R., but no specific overt act is alleged against this petitioner. It is further submitted that other co-accused Raja Choudhary has already been granted bail by this Court, vide order dated 28-02-2020 passed in Cr.Misc. No. 12050 of 2020

Patna High Court CR. MISC. No.24015 of 2020(2) dt.17-09-2020 2/2 (Annexure 2) The petitioner is having clean antecedent and he is in custody since 30-10-2019.

Considering the aforesaid facts and circumstances, the bail application is allowed.

Let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S. Case No. 456 of 2019 on the following conditions:

"(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.".
