Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.
Patna High Court Cr.Misc. No.19083 of 2017 (3) dt.01-07-2017 2/3 In this application for anticipatory bail the petitioners apprehend their arrest in connection with Khagaul P.S. Case No. 22 of 2017 for the offences punishable under sections 147, 341, 323, 324, 307, 504, 506, 148, 354 and 149 of the I.P.C. Allegedly, the petitioners and other accused armed with various weapons came at the shop of the informant and assaulted her and her husband. They tore her blouse and misbehave with her daughter.
Submission is of false implication and that this case has been lodged in retaliation of Khagaul P.S. Case No. 23 of 2017, there is case and counter case, the allegation leveled against the petitioners is not specific rather omnibus in nature, the injury report of husband of the informant indicates that he had sustained injuries like abrasion and body ache and there is no C.T. Scan report in the case diary till date, one of the co-accused, namely, Md. Gyassuddin Quraishi, on similar allegation, has been allowed pre-arrest bail vide Cr. Misc. No. 19221 of 2017 by order dated 13.06.2017 by another co-ordinate Bench of this Court and further co-accused Md. Sonu has already been allowed bail by the learned Magistrate itself and as such the petitioners also deserve sympathetic consideration The learned A.P.P.
fairly submits that Md.
Patna High Court Cr.Misc. No.19083 of 2017 (3) dt.01-07-2017 3/3 Gyassuddin Quraishi has been allowed pre-arrest bail by the coordinate Bench of this Court. In the facts and circumstances as stated above, the petitioners, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of.
