The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 379, 504 and 506 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on 11.06.2020, when he was coming back to his house, he was abused by Ankit and on protest, Suraj assaulted him by an iron rod causing injury on head and when Sanjay came to save him, the accused persons assaulted him with lathi
Patna High Court CR. MISC. No.24663 of 2022(2) dt.10-11-2022 2/3 and danda and Ankit snatched gold chain from neck of Ramlal. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case, it is next submitted that from perusal of the allegations as alleged in the FIR it would manifest that the allegation of abuse and assault is general and omnibus in nature. Further, it is submitted that specific allegation of assaulting Sanjay is on Suraj who is not a petitioner in the present case, it is also submitted that no occurrence, as alleged, had taken place as no injury report has been issued by Doctor as specifically stated at paragraph '16' of the anticipatory bail application.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Piri Bazar P.S. Case No. 62 of 2020 subject to the conditions as laid
