Petitioner apprehends arrest in connection with Khajauli P.S. Case No. 158 of 2018 registered for the offence punishable under sections 419, 420, 120B of the Indian Penal Code and sections 18(c) and 22(3) of the Drugs and Cosmetics Act.
Learned counsel appearing for the petitioner submits that petitioner had no medical shop at Maniharwa Santu Chowk, Khajauli as alleged in the first information report. The recovery of only 6 pieces of medicine worth rs. 200/- is alleged in the F.I.R. Petitioner is employed elsewhere as would be evident from I.D. Proof enclosed as Annexure-2 and he has no
Patna High Court CR. MISC. No.24725 of 2019(2) dt.18-04-2019 2/2 concern with the alleged medicine or the medicine shop. Petitioner is a man of clean antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, III, Madhubani in connection with Khajauli P.S. Case No. 158 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
