JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-04-2022 Heard Mr. Dronacharya, learned Senior Advocate for the petitioner and Mr. Dr. Alok Kumar Sinha for the opposite party no. 2/Dakshin Bihar Gramin Bank, Shakha-Jay Prakash Nagar, Khagaria. The State is represented by Mr. Md. Aslam Ansari, learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Khagaria P.S. Case No. 175 of 2020 dated 03.03.2020 instituted for the offences under Sections 406 and 420 of the Indian Penal Code.

The petitioner had entered into an agreement with the bank for amortizing the loan amount of Rs. 1 Crore by paying an amount of Rs. 89 Lakhs towards full and final settlement of

The entire amount, as agreed upon between the parties, has been paid by the petitioner.

The aforesaid assertion has not been disputed by the counsel appearing for the bank.

Considering the afore-noted fact, the provisional bail granted to the petitioner by order dated 29.01.2022 is, hereby, confirmed.

The petitioner shall remain on the same bail bonds. The application stands allowed and disposed off accordingly.
