ANJANA MISHRA ORAL ORDER 08-10-2015 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Amas P.S.Case No. 96 of 2003 registered under Sections 147, 148, 149, 341, 323, 307, 452, 380, 506, 384 of the IPC and Section 27 of the Arms Act including Section 17 of the Criminal Law Amendment Act.

Learned counsel for the petitioner submits that though the FIR is against unknown persons yet the name of the petitioner has surfaced in the year 2008 for an occurrence of the year 2003. Learned counsel further submits that the entire allegation against the petitioner is based on mere speculation and that he has nothing to do with the present occurrence.

Patna High Court Cr.Misc. No.29711 of 2015 (3) dt.08-10-2015 Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest/surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each in connection with Amas P.S.Case No. 96 of 2003 to the satisfaction of Sri N.P.Singh, Judicial Magistrate, 1st Class, Sherghatti, Gaya, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
