ANJANA MISHRA ORAL ORDER 28-01-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 04.11.2018 in connection with Chakand P.S. Case No.142 of 2018 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner is the Khalasi of the truck from which foreign liquor is said to have been recovered. Learned counsel for the petitioner submitted that the said liquor was not recovered from his conscious possession and vide order dated 17.01.2019 passed in Cr.Misc. No.78308 of 2018 co-accused Shankar Yadav, driver of the truck has since been extended the privilege of regular bail. As such the petitioner may also be granted regular

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Gaya, in connection with Chakand P.S. Case No.142 of 2018.
