JUSTICE SANDEEP KUMAR ORAL ORDER 07-01-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of anticipatory bail in Araria (Mahila) P.S. Case No. 23 of 2015 registered for the offence punishable under Sections 376 of the Indian Penal Code.
The petitioner is accused in a case registered under Section 376 of the Indian Penal Code lodged in the year 2015 and he has also brought a compromise petition on record by way of Annexure -3 dated 09.03.2018.
Considering the nature of allegations and also the fact that this case is of the year 2015, this is not a fit case for grant of anticipatory bail.
It is, accordingly, dismissed.
However, the petitioner is directed to surrender in the
Patna High Court CR. MISC. No.24729 of 2019(10) dt.07-01-2022 2/2 court below within 10 weeks from today and pray for regular bail. If such an application is filed, the Court shall consider and decided the same in accordance with law and on the basis of materials which may be produced at the time of hearing of the regular bail application.
With the aforesaid direction and observations, this application is dismissed.
