It appears that the Petitioner has filed the present allegation against the order of cognizance dated 13.9.2011 passed by the Judicial Magistrate, 1st Class, Evening Court, Distt. Madhubani, in G.R. Case No. 1441 of 1999, Trial No. 143 of 2011 arising out of Madhubani Nagar P.S. Case No. 253 of 1999. At one point in time when this Court directed the Petitioner to file an affidavit with regard to the present stage of Trial, such an affidavit was filed stating therein that charges have now been framed on 18.3.2013, hence, evidently, this application has become infructuous.
It is dismissed as such.
The Trial Court is directed to expedite the Trial
Patna High Court Cr.Misc. No.38991 of 2011 (7) dt.03-02-2015 2/2 since this is an old matter for which reason, he is directed to send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of this order in connection with G.R. Case No. 1441 of 1999, Trial No. 143 of 2011 arising out of Madhubani Nagar P.S. Case No. 253 of 1999, to the Superintendent of Police, Madhubani, and the Superintendent of Police, Madhubani, is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
