The petitioner seeks bail in anticipation of his arrest in connection with Chakmehsi P.S. Case No. 250 of 2020 instituted for the offences under Sections 272, 273 and 34 of the Indian Penal Code.

On secret information that the petitioner has arranged for liquor to be brought from some place, a raid was conducted in which 457 litres of liquor was found to be stored near a bio-gas plant behind the house of one Anmol Pandey. So far as the petitioner is concerned, his accusation in this case is only on the basis of suspicion. There is no recovery from the conscious or constructive possession of the petitioner and the petitioner also does not have any concern with co-accused Anmol Pandey

The petitioner does not have criminal antecedents. For the afore-stated facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-cum-Special Judge (Excise Act), Samastipur, in connection with Chakmehsi P.S.
