The petitioners have preferred this application for grant of regular bail in a case registered under section 302 and other sections of the Indian Penal Code.
As per the prosecution case, it is stated by the informant that the four accused persons named in the F.I.R. including the two petitioners herein brutally assaulted the brother of the informant who subsequently died in course of
Patna High Court CR. MISC. No.24543 of 2022(3) dt.12-01-2023 2/2 treatment.
It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case. The allegations are general and omnibus in nature. The petitioners are in custody since 24.9.2021 and have no criminal antecedent. Chargesheet has been submitted in the case.
Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation, the general and omnibus allegation in the F.I.R. together with the petitioners having remained in custody for over a year since 24.9.2021, the Court directs the two petitioners to be enlarged on bail in connection with Banmankhi P.S. Case no.304 of 2021 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea.
