Perused the record of Cr. Misc. No. 34975 of 2008 in which a liberty was granted to the petitioner to renew his prayer if the judgment was not delivered in the first quarter of 2009. There is no dispute that the judgment was not delivered and, as such, the Court had admitted the respondent to bail.
Submission was that after release of the petitioner from prison, he was named in a First Information Report under Section 302 etc. of the Indian Penal Code. I peruse the copy of the First Information Report which is enclosed as Annexure-3 to the present petition and I do not see any reason in spite of finding the petitioner named in the First Information Report to cancel the earlier order of bail in his favour.
The petition for cancellation of bail is dismissed. (Dharnidhar Jha, J.) Sanjay/- U T
