ANJANA MISHRA ORAL ORDER 08-10-2015 Heard learned counsel for the petitioner and learned counsels appearing on behalf of the State and the informant. The petitioner being the married Nanad of the deceased is apprehending her arrest in connection with Bhagwanpur P.S.Case No. 57 of 2015 registered under Sections 304B and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is a married Nanad residing at her sasural and has no connection with the present occurrence and merely because she being one of the family members has been brought in the present FIR.
Learned counsel for the informant submits that all the members of the family had in fact participated in the occurrence
Patna High Court Cr.Misc. No.29755 of 2015 (3) dt.08-10-2015 leading to the death of the deceased.
However, in view of the facts and circumstances, let the petitioner, above named, in the event of her arrest/surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each in connection with Bhagwanpur P.S.Case No. 57 of 2015 to the satisfaction of the Chief Judicial Magistrate, Bhabua, District Kaimur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
