====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 28-01-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner has been in custody since 27.10.2018 in connection with Paraiya P.S. Case No. 169/2018 registered for the offense punishable under Sections 30(A) of the Bihar Prohibition and Excise Act.
The allegation against the petitioner is of recovery of 40 liters of Mahua wine from a Wagon-R vehicle which had fallen into a ditch. It is further alleged that when the vehicle was taken out from the ditch, it was found that it was also containing liquor.
Learned counsel for the petitioner submits that neither was he present in the vehicle nor does the vehicle belong to him.

No.78420 of 2018(2) dt.28-01-2019 2/2 Considering the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya, in connection with Paraiya P.S. Case No. 169/2018.
