JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 01-07-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Kasba (Jalalgarh) Police Station Case No. 235 of 1997, disclosing offences under Sections 304B/120B/34 of the Indian Penal Code.

Learned Counsel for the petitioner has submitted that the petitioners are not even remotely related to the husband of the deceased. They have been maliciously implicated in the instant case. He has also submitted that the petitioners were not knowing that the criminal case is still continuing against them and, therefore, they could not take any step for their release on

Patna High Court Cr.Misc. No.27177 of 2017 (3) dt.01-07-2017 2/2 anticipatory bail earlier.

Considering the facts and circumstances, this application is allowed.

Let the petitioners, namely, Renu Devi and Arbind Kumar Mandal @ Arvind Mandal, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Kasba (Jalalgarh) Police Station Case No. 235 of 1997, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
