The petitioner has preferred this application for grant of regular bail in a case registered under sections 20 and 22 of the NDPS Act.
As per the prosecution case, on the information provided by the petitioner who is stated to be a tempo driver, raids were conducted and narcotic drugs were recovered from the houses of the different accused persons.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. Even as per the allegations in the F.I.R., no incriminating article has been recovered from his possession. Allegation that the recovery took place on the basis of information provided by the petitioner
Patna High Court CR. MISC. No.36077 of 2021(2) dt.23-12-2021 2/2 is false and concocted. The petitioner is in custody since 3.12.2020 and chargesheet has been submitted in the case. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for more than 1 year, the Court directs the petitioner to be enlarged on bail in connection with Town P.S. Case no. 784 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Muzaffarpur.
