ANJANA MISHRA ORAL ORDER 08-10-2015 Heard learned counsel for the petitioners and learned counsels appearing on behalf of the State and the informant. The petitioners are apprehending their arrest in connection with Karpi P.S.Case No. 28 of 2015 registered under Sections 341, 323, 504, 506/34 and 302 of the Indian Penal Code. Learned counsel for the petitioners submits that the entire case against these petitioners is false and concocted, the reason being the land dispute. Learned counsel further submits that the death of the lady in question occurred on account of Cerebro Vascular Accident as she was suffering from hyper tension. Learned counsel also draws to the notice of the Court that other similarly situated accused persons have been extended the benefit of anticipatory bail in Cr.Misc.No. 32285 of 2015 vide order dated 14.8.2015.
Patna High Court Cr.Misc. No.29852 of 2015 (3) dt.08-10-2015 Considering the aforementioned facts and circumstances, let the petitioners, above named, in the event of their arrest/surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each in connection with Karpi P.S.Case No. 28 of 2015 to the satisfaction of Sri B.N. Tripathi, Judicial Magistrate, 1st Class, Jehanabad, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
