====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Chandan P. S. Case No.28 of 2021, instituted for the offences under Sections 30(a)(g)/ 32(2) of the Bihar Prohibition and Excise Amendment Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 15.02.2021 and charge-sheet has been submitted in the case.

The allegation is of recovery of 38.250 litres of Indian made foreign liquor from the back seat of the Honda City car and the petitioner is alleged to be the driver of the said car and as such, he was not knowing what was being carried in the said vehicle.

Considering the fact that the petitioner is in custody since 15.02.2021 and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Banka in connection with Special Excise Case No.116 of 2021 arising out of Chandan P. S. Case No.28 of 2021. The application stands allowed.
