The petitioner, who is in custody since 31.05.2020 and claims to be a person of clean antecedent, seeks bail in connection with Bihpur P.S. Case No. 25 of 2020, dated 21.01.2020, instituted for the offences under Sections 30(a) and 38(ii) of
Patna High Court CR. MISC. No.21743 of 2020(2) dt.08-07-2020 2/3 the Bihar Prohibition and Excise Act, 2016.
On secret information that liquor is being sold from a dilapidated house, a raid was conducted and one Raushan Kumar is said to have been arrested. Aforesaid Raushan Kumar has named the petitioner and others as his associates. From the orchard attached to the old house, which was raided, 382.48 liters of liquor was recovered. From the shop of aforesaid Raushan Kumar, approximately 49.85 litres of liquor was recovered.
It has been submitted on behalf of the petitioner that he has been implicated in this case only on the basis of confession of an arrested accused person.
Considering the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. District and
Patna High Court CR. MISC. No.21743 of 2020(2) dt.08-07-2020 3/3 Sessions Judge-Cum-Special Judge (Excise), Bhagalpur, District-Bhagalpur in connection with Bihpur P.S. Case No. 25 of 2020.
