Mr.Pranav Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 07-04-2023 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioner and learned APP for the State.

This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 395 of the Indian Penal Code, registered in connection with Chenari P.S.Case No. 70 of 2021.

As per allegation, some accused persons including the petitioner snatched the mobile phone of the informant at the point of pistol.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.24577 of 2022(4) dt.07-04-2023 2/3 that the petitioner has falsely been implicated in this case. He is in custody since 26.07.2021. He has submitted further that on similar footing other accused persons have been granted bail by coordinate Benches of this Court in Cr.Misc. Nos.7595 of 2022, 21480 of 2022, 11197 of 2022 and 20211 of 2022, respectively. He has also submitted that the case of the petitioner is on similar footing.

Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Sasaram in connection with Chenari P.S.Case No. 70 of 2021, subject to the following conditions:-

1. The petitioner shall cooperate in the disposal of trial and make available available as and when required by the court.

2. If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.

Patna High Court CR. MISC. No.24577 of 2022(4) dt.07-04-2023 3/3 Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
