The petitioner apprehend his arrest in connection with Rajoun P.S. Case No. 458 of 2020 registered for the offence under Sections 302/34 of the Indian Penal Code. The bail application of petitioner no.2 namely, Raghu Yadav @ Raghunandan Yadav has been dismissed as withdrawn vide order dated 09.09.2021.

Considering the fact that the petitioner no.1 has been named in the F.I.R. by the person who has seen the incident having occurred. While the arguments being raised by the learned counsel for the petitioner no.1 that the case may not have come within the ambit of Section 302 of the I.P.C. but

Patna High Court CR. MISC. No.34000 of 2021(4) dt.10-02-2022 2/2 under Section 304 of the I.P.C. may be taken at the relevant stage, I am not inclined to grant benefit of anticipatory bail to the above named petitioner no. 1.

Accordingly, the prayer for anticipatory bail is rejected.
