The petitioner seeks bail in connection with Hussainganj P.S. Case No. 276 of 2018 for the offence under Sections 30(a), 36, 41(1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, nothing has been recovered from the conscious possession of the petitioner. The petitioner is rotting in custody since 03.09.2018.

Considering the facts and circumstances of the

Patna High Court Cr.Misc. No.78601 of 2018(2) dt.25-01-2019 2/2 case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-2nd -cum- Special Judge Excise, Siwan in connection with Hussainganj P.S. Case No. 276 of 2018.
