Petitioner seeks bail in a case registered for the offences punishable under Section 147, 148, 149, 324, 353, 307, 326, 435, 379, 427, 302 of the Indian Penal Code, Section 27 of the Arms Act, Section 3⁄4 of the Explosive Substance Act, Section 17 of the C.L.A. Act, and Section 10 of the Unlawful Activities Act.

Petitioner is in custody since 26.02.2018. The FIR is against 250 to 300 unknown extremist, who allegedly looted away arms and ammunition of the police party. Submission is that during investigation no substantial material came against the petitioner and some other co-accused. Hence, most of the co-accused have been allowed bail in this case by different Co-Ordinate Benches of this Court, detailed in

Patna High Court CR. MISC. No.78480 of 2018(4) dt.16-04-2019 2/2 para 13 of the bail petition. Some of them are such accused who had confessed before the police and named the petitioner in their confessional statement.

Considering the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Goh Police Station Case No. 140 of 2013, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
