JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 01-07-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Bhagwanganj P.S. Case No. 46 of 2016 for the offences punishable under sections 304 B and 201 of the I.P.C and section 3⁄4 of the Dowry Prohibition Act. The learned counsel for the petitioner submits that the petitioner is Dever of the deceased. The matter has been compromised between the parties. The informant has filed petition in this regard in the learned court below, copy of which is Annexure-3. Co-accused Punam Devi, who is mother-in-law, has been allowed pre-arrest bail vide Cr. Misc. No. 9608 of 2017 by
Patna High Court Cr.Misc. No.19559 of 2017 (3) dt.01-07-2017 2/2 another co-ordinate Bench of this Court and as such the petitioner also deserves sympathetic consideration as there is general and omnibus allegation.
The learned A.P.P. submits that now the informant is retracting from her earlier version.
In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. Sri N.K. Tyagi, J.M 1st Class, Masaurhi, Patna in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
