2. Pursuant to the order dated 13.02.2024, third supplementary counter affidavit has been filed. As per it, the loss of crops has been assessed by the respondents to the tune of Rs. 45,152/- and as per the assessment report, the Executive Engineer, Rural Works Department, Work Division, Neemchak Bathani vide his office letter no. 298 dated 07.03.2024 has already requested the Engineer-in-Chief, Rural Works

Patna High Court CWJC No.10719 of 2021(6) dt.28-03-2024 2/2 Department, Bihar, Patna to make available the aforesaid fund (Rs. 45,152/-).

3. Learned counsel for the petitioner submits that the assessment made by the respondents is meager for which he be given liberty to agitate before appropriate authority.

4. This Court is satisfied that the respondents have assessed the loss and further requested to immediately make the amount available. However, the process cannot continue forever and as such, it would be appropriate that the same shall be transferred to the account of the petitioner within a period of four weeks from today, if the same has not been made.

5. Learned counsel for the petitioner undertakes to provide the bank account number to the learned State Counsel in course of the day though he submits that the petitioner has already provided the bank account to the concerned authority.

6. The writ petition stands disposed of with the aforesaid observation.
