JUSTICE SUDHIR SINGH ORAL ORDER 12-09-2017 The petitioner, in the present writ application has sought for a direction upon the respondent for quashing of the order, contained in Memo No.02 dated 07.01.2015, issued from the office of Respondent no.2, by which, minor punishment has been imposed upon the petitioner withholding of two increments of pay without cumulative effect, under Rule-14 of the Bihar Government Servant Classification, Control and Appeal Amendment Rules, 2005, without holding an inquiry as envisaged under Rule-19 of the said Amended Rules.
Considering the relief sought for, on behalf of the petitioner, the petitioner is directed to prefer an appeal under Bihar
Patna High Court CWJC No.17037 of 2015 (2) dt.12-09-2017 2/2 C.C.A. Rules, 2005 before the competent authority, within a period of 45 days. The appellate authority shall consider the appeal of the petitioner and pass a reasoned order, in accordance with law.
With the aforesaid observation and direction, the present writ application stands disposed of.
