ANJANA MISHRA ORAL ORDER 28-01-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 19.10.2018 in connection with Bounsi P.S. Case No. 304 of 2017 registered for the offence under Sections 302,34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that so far as the present petitioner is concerned, though named in the FIR, no particular role has been attributed to him. It is further submitted that the main allegation is against three persons who are said to have dragged the husband of the informant into nearby house and has indulged in mar-pit leading to his death. It is further submitted that so far as the present petitioner is concerned the FIR itself indicates that initially he was standing
Patna High Court Cr.Misc. No.78527 of 2018(2) dt.28-01-2019 2/2 there but he has not been shown as aggressor. Learned counsel for the petitioner has further submitted that the petitioner has a clean antecedent and shall co-operate during course of trial. Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Bounsi P.S. Case No. 304 of 2017.
