The petitioner apprehends his arrest in connection with Saraiya P.S. Case No.291 of 2021 registered for offences under Sections 272, 273 and 34 of the Indian Penal Code and Sections 30(a) and 37(b) of the Bihar Prohibition and Excise Act, 2016.
Considering the fact that the petitioner has clean antecedent and recovery of illicit liquor has not been made from his house, this application for anticipatory bail is allowed. Accordingly, let petitioner, above-named, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.24464 of 2022(2) dt.20-05-2022 2/2 satisfaction of learned Exclusive Special Judge Excise, Court No.II, Muzaffarpur in connection with Saraiya P.S. Case No.291 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
The petitioner will visit Saraiya Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
