JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 15-11-2016 Heard the counsel for the petitioner and the informant. The petitioner being husband of the deceased is facing prosecution in Dagarwa P.S. Case No. 05 of 2016 registered under Sections 304B/34 of the Indian Penal Code and 3⁄4 of D.P. Act and has approached this Court for grant of anticipatory bail. Not only the allegation is of murdering of the sister of the informant but from Annexure-2 it appears that the petitioner also attempted to tamper with the evidence.
It is submitted that Doctor in the autopsy report found no external or internal injury on the person of the deceased. Learned APP on the other hand submits that from perusal of First Information Report, it would appear that the deceased was re-married with the petitioner, whereafter she was subjected
Patna High Court Cr.Misc. No.28345 of 2016 (4) dt.15-11-2016 2/2 to torture and ultimately done to death.
In my view, it is not fit case for grant of anticipatory bail. The prayer is rejected.
